Event Details

Aims:  

This one day course is designed to enable participants to identify when applications need to be made to the Court of Protection to authorise deprivation of liberty and to comply with the requirements set down by the Court for making such applications.

Learning outcomes:

By the end of the day participants will have learned:

  • The key legal principles governing deprivation of liberty in the community setting
  • To identify and collate the necessary evidence for making applications to the Court of Protection to authorise deprivations of liberty in the community setting

Programme:  

The day will include the following key topics:

  • Introduction and overview of the day
  • Deprivation of liberty after Cheshire West
  • Re X: the case, the process, and the future
  • Capacity: assessing and collating evidence
  • Best interests: assessing and collating evidence
  • Further discussion and questions, evaluations and close

The course will be delivered by Alex Ruck Keene 

Alex is a barrister at 39 Essex Chambers.  He has been recommended as a leading expert in the field of mental capacity law for several years, appearing in cases involving the MCA 2005 at all levels up to and including the Supreme Court. He also writes extensively about mental capacity law and policy, works to which he has contributed including ‘The Court of Protection Handbook’ (Revised first edition, 2015, LAG); ‘The International Protection of Adults’ (‘2015, Oxford University Press), Jordan’s ‘Court of Protection Practice’ and the third edition of ‘Assessment of Mental Capacity’ (Law Society/BMA 2009). He is an Honorary Research Lecturer at the University of Manchester, a Visiting Research Fellow at the University of Manchester and the creator of the website www.mentalcapacitylawandpolicy.org.uk.

Edge provides specialist consultancy and training on the operation of the Mental Health Act (MHA) and the Mental Capacity Act (MCA).  Several of our directors and trainers are leading authors in the field.  We use highly experienced trainers, all with direct work experience in relation to people with mental health problems and/or limited mental capacity, to deliver training. We are commissioned by Local Authorities, NHS Trusts, CCGs and private providers.  We train a wide range of staff groups including psychiatrists, AMHPs, BIAs, social workers and nurses. We concentrate on making the law accessible to these staff groups so that it can be applied in practice. All of our training is practical and involves case studies tailored to the needs of each group.
