Event Details

Aims:  

This course aims to provide an essential update on case law, research and other developments in relation to the role of the BIA. Please note that the topics and case law covered will cover the most significant DoLS developments for BIAs in 2015-2016.

Learning outcomes:

  • Know the latest DoLS news, research and guidance
  • Examine the differences between a restriction on liberty and deprivation of liberty considering lessons from case law
  • Discuss the latest relevant case law and reflect on how this affects practice

Programme:

The content below may be slightly modified and updated to reflect the latest case law prior to the training day:

  • Latest news and guidance
  • Latest case law and research on medication
  • Medication and the role of the BIA report
  • Case law – ICUs and DoLS
  • Positive duty on local authorities
  • AJ v a local authority – the representative
  • Young People and DoL
  • Best interests case law and stated wishes/belief/values
  • P v Surrey CC and CCG – duration, authorising signatory and less restrictive           
  • Law Commission- the interim statement
  • Exercises and a quiz to test and reinforce knowledge will also be included.                          

 

The course will be deliverd by Aasya Mughal 

Aasya is a barrister and director of Edge. She has provided legal representation for individuals and businesses in civil law matters in the county courts including landlord and tenant proceedings. She also has previously gained considerable experience as an in-patient advocate, working with detained patients on a number of mental health wards and has appeared before the Court of Protection in this role. She is co-author of three books, an App and three wall charts on the Mental Health Act, Mental Capacity Act and DoLS used by local authorities, hospitals, universities and lawyers. She has also provided legal information and advice to the public on human rights law through the organisation Liberty on a pro bono basis.

Edge provides specialist consultancy and training on the operation of the Mental Health Act (MHA) and the Mental Capacity Act (MCA).  Several of our directors and trainers are leading authors in the field.  We use highly experienced trainers, all with direct work experience in relation to people with mental health problems and/or limited mental capacity, to deliver training. We are commissioned by Local Authorities, NHS Trusts, CCGs and private providers.  We train a wide range of staff groups including psychiatrists, AMHPs, BIAs, social workers and nurses. We concentrate on making the law accessible to these staff groups so that it can be applied in practice. All of our training is practical and involves case studies tailored to the needs of each group.
