Confusion plays a fundamental role in establishing passing off and infringement and registrability in trade mark cases and yet, what is required to show confusion is underexplored. This seminar considers the issue from a legal perspective, in terms of what courts in the UK and the US require of parties in order to show confusion, and through the examination of cutting-edge consumer behavioural science and marketing research.
