The law of duty of care towards Covert Human Intelligence Sources and Protected Persons (whether or not in the witness protection scheme) has been considered by both the High Court and Court of Appeal recently and it is clear that a principled approach needs to be established to ensure that the public and law enforcement have confidence in the system moving forward. 

 

 

 

In response to the developments in what is already a complicated topic of law, Covert Policing Training & Publishing company is holding a seminar to assist those working in this area navigate their way through the complex matrix that now exists and look at how it may develop in the future. 

 

 

 

This presentation will consider the following issues:

 

 

 

  • From where the duties of care arise;
  • the recent cases of An Informer v A Chief Constable and (1) PBD and (2) v Chief Constable of Greater Manchester Police;
  • identifying the principles;
  • assessing the vulnerabilities ; and
  • extracting good practice and avoiding pitfalls  

The speaker is Simon McKay, barrister and criminal and human rights law expert. He is the author of best-selling Covert Policing: Law & Practice (2nd Ed, March 2015, OUP), Undercover Cop: Principles, Pitfalls and Good Practice and is the General Editor of Covert Policing, Terrorism and Intelligence Law Review
