This seminar will consider several types of title defects with the aim of helping the conveyancer identify the relevant legal issues, the risks involved, and a practical approach to answering the question of whether the title is good and marketable.

This presentation covers issues such as:-

  • Key characteristics of a valid easement, including prescriptive rights
  • Rights of way: Their scope and adequacy
  • Is the easement still exercisable?
  • Breach of restrictive covenant requiring consent & likelihood of enforcement action
  • The seller’s duty of disclosure at common law & interaction with consumer protection law
  • Ascertaining whether the boundaries of a property are correctly drawn
  • Matters arising when the property is liable to flooding
  • Seeking disapplication of a Land Registry restriction
  • Powers of attorney: validity, revocation & genuineness

This seminar is aimed at achieving Competency Statement B – Technical Legal Practice: To give an increased knowledge of the subject matter; to update on current issues, case law and statutory provisions and to be able to apply the knowledge gained in the better provision of a service to the client.

Speaker: Since 2004, Stephen Desmond has delivered more than 1,500 CPD seminars and conferences on a range of subjects relating to commercial and residential property transactions. As a contributing editor to Butterworths Property Law Service, published by LexisNexis, Stephen writes on the complex law relating to long residential leases.

A former practising Solicitor with several years post-qualification experience, he has represented many business and private clients.


Please note that this seminar will be held in the Ranmore Suite on the Ground Floor at Denbies Wine Estate, Dorking. Registration is from 1.30pm with tea and coffee. The session will commence at 2.00pm and finish at 5.15pm with a 15 minute break at about 3.30pm for tea.
