Intellectual Property – Brexit Implications
Trade marks can be seen as market protection of non-technological innovation, and as such are utilised by virtually all parts of an economy, including services. Trade Marks are also a means by which reputations for quality and reliability can be secured for a product or service and a market cachet established as an intangible corporate asset.
As part of being a member of the EU, Britain has been a member of the EU Trade Mark system, and indeed has generally been the second most active member in this area after Germany, but also by some margin the most significant registrant representative on non-EU entities. Moreover, Trade Marks can be seen as one aspect of an array of actions an enterprise can undertake to protect their intellectual property - including patents, designs, copyright and geographic indications.
