Annual Meeting followed by Employment Update, The Fall and Rise of the Employment Tribunal

We all are aware that the sudden ending of the Employment Tribunal fee regime in 2017 has led to a dramatic increase in the number of tribunal claims.

One consequence of this is that the decisions of employers, and the advice given by HR professionals, are now far more likely to be scrutinised by an employment judge than they were a couple of years ago.

Given that employment tribunals are back in a big way we all need to understand how they operate and review the practical steps we can take to avoid being caught in the rising tide of claims.

Fortunately we welcome back Kirk Tudhope and Sine Mackay from Ledingham Chalmers LLP’s employment team to demystify tribunals, provide some practical tips on how to avoid them and how to win them if you can’t.

Topics covered will include:

1. A practical guide to tribunal procedure
2. How to best present your case
3. What’s it like to be a witness
4. The role of ACAS including how to best use any pre-tribunal early conciliation process
5. 5 things employers can do to avoid tribunals
6. The myth of the “employee friendly” tribunal
7. Why the outcome should never be a lottery.

Employment Law Speakers

Kirk Tudhope
Kirk Tudhope is a partner with Ledingham Chalmers based in their Inverness Office. Kirk heads the Firms’ Employment Law Team in Inverness and Aberdeen and has advised employers on the challenges arising from the workplace for over 25 years.

Kirk is the only Law Society of Scotland accredited specialist in Employment Law based in the Highlands and is recognised in the leading guides to the Legal Profession: Chambers and Partners and Legal 500. He represents employers throughout the North and North East ranging from small businesses to some of the region’s leading employers including Lifescan Scotland and Baxters Food Group.

Away from the office Kirk is a former Chair of Highland Hospice and currently Chair of Highland based Social Enterprise charity ILM Highland. His interests also include accumulating vinyl records and supporting Kilmarnock Football Club albeit from a safe distance.

Sine Mackay
Sine is a senior associate with Ledingham Chalmers also based in the firm’s Inverness office. She advises employers throughout the North and North East on a wide variety of employment law and human resources issues. Sine also handles queries on data protection and the freedom of information.

In addition to her legal qualifications Sine holds a Masters degree in Human Resource Management and is an Associate Member of the Chartered Institute of Personnel and Development. Sine is also recognised in the leading guides to the Legal Profession: Chambers and Partners and Legal 500. Along with Kirk she is the only employment lawyer based in the Highlands to be recommended in both.
Away from the office Sine’s interests include agriculture, running and cycling.
