To provide an overview of what is meant by capacity and consent and the legal framework for suporting decision making with someone with a learning disability.In the NHS and social care, we must obtain a person’s consent before providing any care or treatment.

Consent means a person’s voluntary and informed agreement to receive the proposed care or treatment. This process should begin with a clear explanation of what is being proposed, including its purpose, potential risks and benefits, and any reasonable alternatives.
