Unlike some other litigation, contentious probate, will disputes and Inheritance Act claims are increasing year on year. This course is designed for litigators who are already engaged in this area and wish to have a broader knowledge of the subject. It is also for those who wish to develop their knowledge in this field and enable them to start to build a practice in an area which is both interesting and challenging in equal measure. The lecture will look at the legal basis behind bringing and defending claims, and also the practical steps before and during court proceedings, together with methods of resolving claims outside the courtroom.

This course will look at:

  • Different types of claim
  • Probate and intestacy
  • Challenging a will
  • Larke-v-Nugus requests
  • Inheritance Act claims: factors to consider, pre-action steps, the effect of prenuptial agreements, dispositions intended to defeat claims
  • Pre-issue and post issue steps
  • Case Management
  • ADR in probate claims
  • Costs: usual rules and exceptions, Part 36 offers and conduct of parties
  • Claims against solicitors

This seminar is aimed at achieving Competency Statement B – Technical Legal Practice: To give an increased knowledge of the subject matter; to update on current issues, case law and statutory provisions and to be able to apply the knowledge gained in the better provision of a service to the client.

Speaker: Richard Land qualified in 1993 and is a partner with Owen White and Catlin LLP and head of the litigation department dealing with contentious probate and other claims. He has been a speaker for 7 years, and he has extensive experience in dealing with Contentious Probate, Inheritance Act claims and possession claims on behalf of executors.


Please note that this seminar will be held in the Ranmore Suite on the Ground Floor at Denbies Wine Estate, Dorking. Registration is from 1.30pm with tea and coffee. The session will commence at 2.00pm and finish at 5.15pm with a 15 minute break at about 3.30pm for tea.
