This online workshop, using the law relevant to England only will cover:

• Details about the Mental Capacity Act 2005 and at what age this starts to apply, and how best interests decision making works for somebody who lacks capacity.
The role of the Court of Protection.
Welfare deputyships – what are they.
Who can be a deputy?
What kind of circumstances would make a welfare deputyship necessary?
Practical steps to seeking deputyship, what things need to be done first?
The role and responsibility of a deputy.
Is deputyship really required? How do you maintain a voice in decision making?

This workshop will be facilitated by David York, Chartered Legal Executive from Irwin Mitchell LLP.

David York is a Chartered Legal Executive in the Public Law & Human Rights team, specialising in Court of Protection and community care cases. He joined Irwin Mitchell as a paralegal in 2018, before qualifying with the firm in 2023.

David represents vulnerable adults and their families in cases where disputes occur either in relation to mental capacity or best interests. Often these disputes can be in relation to where somebody lives, or what contact they have with other people in their lives. He acts on behalf of the Official Solicitor, Independent Mental Capacity Advocates (IMCAs) and family members in Court of Protection cases under the Mental Capacity Act 2005. David also helps to challenge decisions made by public authorities, such as where unlawful assessments of a person's needs has resulted in them getting far less support than they in fact require.

This workshop will be held on Zoom. We will give advice on how to install and use Zoom before the workshop is held, if you require this. If you prefer to not be visible or audible on screen that is fine by us.
