Funding for development brings together lenders, lawyers and developers where the overarching pace of the planning system, or more frequently the slow and often interrupted flow of planning control, means that those engaged in the process on both sides of borrowing funds need to be aware of the pitfalls so that commercial arrangements can allow for all known unknowns and avoid schemes becoming bogged down in unexpected delays with financial consequences.

Speaker details:

KEVIN LEIGH has been a barrister since 1986. He is also a qualified mediator. He advises and appears in all areas of planning control. His practice includes residential matters (from single unit to estate schemes) through to commercial and industrial sites (such as retail, office, leisure and hotel projects) as well as traveller cases, in both civil and criminal arenas. His property practice, often overlaying development work, deals with boundaries, easements, trespass, nuisance, covenants and local authority conduct. He is a member of the Planning & Environment Bar Association, Chancery Bar Association and Property Bar Association. He was vice chair of the Bar Council committee dealing with public and licensed access and sat as a judge on The Disciplinary Tribunal of the Council of the Inns of Court dealing with professional complaints against barristers.

DERMOT FLANAGAN S.C. was called to the Bar of Ireland in 1987 and appointed Senior Counsel in 2000. Mr. Flanagan is a Fellow of the Chartered Institute of Arbitrators and acts as mediator, arbitrator and in expert determinations. He practices from the Law Library, Dublin & as an arbitrator/mediator from 33 Bedford Row, London. Mr. Flanagan has particular experience in public and private infrastructure disputes. His practice experience covers road schemes, landfill, marine and wastewater/water; metro; airport and strategic development zones. Mr. Flanagan is a member of the panel of Arbitrators of the Law Society of Ireland and the Dispute Resolution Authority of the Gaelic Athletic Association. He has recently been appointed as Judicial Chair to Sport Dispute Solutions Ireland (SDSI).

Moderator details:

MAURICE O’CARROLL called to the Scottish Bar in 1995 and to the Bar of England and Wales in 2019. He has been a Legal Associate of the Royal Town Planning Institute since 1998 and has practised in the field of Planning and Environmental Law continuously since that time. His practice experience is varied, and he has represented housing developers, wind farm developers, local authorities and third-party objectors at planning inquiries. Most recently, Mr O’Carroll was instructed in a double planning inquiry in relation to wind farm proposals in Argyll, Scotland. Prior to that, he acted for a grouping of third-party objectors who were opposed to the Tennis Academy and housing development promoted by Judy Murray in Perthshire. Mr O’Carroll regularly appears in court in order to challenge planning decisions by means of judicial review as well as statutory appeal. He is the Vice Chairman of the Scottish Bar Planning Group, a Fellow of the Chartered Institute of Arbitrators and a member of the Faculty of Advocates Alternative Dispute Resolution Service.
