Digital Wars: The Rule of Law or the Rule of Code? - Professor Gregor Noll (Lund University) - Kent Law School Staff Seminar Series

Is it possible to subject algorithmic forms of warfare to the rule of law? In my talk, I shall first explore the rule of code, drawing on examples of algorithmic weapons systems currently under development. I shall then show how contemporary legal rules on the allocation of legal responsibility confront us to unanswerable questions as soon as we seek to apply them to algorithmic weapons systems. I then recall how legal code is traditionally imagined: as excarnate law to be incarnated into the world through the human studying the law over and over again. This allows me to argue that algorithmic code is radically different in that this repetition process is moved into the machine, and that any human observation of its outcome takes place too late for any sufficiently insightful correction of the algorithm to take place.
