"Disability, Discrimination and Decision Making", CIPD Event In Partnership...

One of the biggest challenges for all those with HR or management responsibilities remains balancing the duties to assist disabled people in the workplace with the pressures of running a business. We all like certainty but the need to make judgment calls based on the unique circumstances of each case has never been more important.
Fortunately, employment lawyers Kirk Tudhope and Sine Mackay of Ledingham Chalmers Employment Team return to discuss and provide pragmatic support on how to deal with challenges arising from disability in the workplace. Last year they focussed on absence management but there are far wider issues for us all.
The event includes discussion and workshops. Issues covered include:
1. How to deal with suggestions that ill heath may have led to misconduct or poor performance?
2. Does it matter that the employer was unaware of the disability?
3. Should we preserve salary in all cases of disability related absence? and
4. What changes can be made to terms and conditions if a disabled employee requires to take up a less demanding role?
Kirk and Sine will also review the extent employers may be liable for disability discrimination even if they did not know the employee was disabled.
The event is focussed on practical scenarios that we all face and is aimed at HR advisers, business owners and managers. Attendees will benefit from clear guidance on how to approach disability including being better placed to balance the risks, support employees while protecting the business and identify where challenge is most likely.

Kirk Tudhope is a partner with Ledingham Chalmers based in their Inverness Office. He heads the Firms’ Employment Law Team and has advised employers on the challenges arising from the workplace for over 25 years.
Kirk is the only Law Society of Scotland accredited specialist in Employment Law based in the Highlands and is also recognised in the leading guides to the Legal Profession: Chambers and Partners and Legal 500. Kirk represents employers throughout the North and North East ranging from small businesses to many of the region’s leading employers. He is also a well known speaker on employment law issues including at events for the CIPD dating back over 15 years.
Away from the office Kirk is a former Chair of Highland Hospice and currently is on the Board of two Highland based Social Enterprise Charities including being the Chair if ILM Highland.
Sine Mackay is an associate with Ledingham Chalmers and is also based in the firm’s Inverness office. Since 2008 Sine has advised employers throughout the North and North East on a wide variety of employment law and human resources issues. Sine also advises on the increasingly important area of Data Protection and employee privacy.
In addition to her legal qualifications Sine holds a Masters degree in Human Resource Management and is an Associate Member of the Chartered Institute of Personnel and Development. She has also been recognised in the latest edition of Chambers and Partners as one of only 4 rising stars amongst employment law advisers in Scotland.
