PEAT Outcome - relevant legal knowledge

OBJECTIVES

To develop a practical understanding of arbitration and judicial review in modern dispute resolution, including when, why and how they are engaged.

PARTICIPANTS

This event will be of particular interest to solicitors, advocates, academics, policy makers, public body decision makers, advocacy and support workers as well as anyone with an interest in Scots public law and the developments in alternative forms of dispute resolution.

SPEAKERS

William Frain Bell, Advocate. William was educated at Loretto School (where he is a current Governor) before taking an MS at St Andrews University followed by an LLB at University. He is qualified solicitor with Tods Murray WS before calling to the Bar in Scotland in 1999. In 2000 William was also called to the Bar of England and Wales (Middle Temple) and is a member of Thomas More Chambers in London. He is a fellow of Chartered institute of Arbitrators and a Chartered Arbitrator. Since calling to the Bar, William has appeared in both the UK Supreme Court and the Privy Council, the Inner and Outer Houses of the Court of session, the High Court of England and Wales, the Sheriff Court, the Scottish Land Court, the Upper Tribunal (Tax and Chancery Chamber) and before arbitration Tribunals in the UK and internationally . William has particular experience appearing as counsel for both claimants and respondents in construction related disputes in the Middle East and has a good working knowledge of the UAE Civil Code. He is spearheading, with others, the launch of Faculty of Advocates Arbitration and its personal injury arbitration services platform, which is due to be launched in 2018. William is currently instructed as junior counsel in an investor state arbitration (expropriation claim) brought by a listed Indian infrastructure engineering company against the sate of Mauritius.

Alasdair Sutherland, Advocate. Alasdair principally practices in the areas of planning, commercial property and leasing, commercial contract, and professional negligence, and represents clients in all types of courts and forums, including ADR. He is a Standing Junior to the Scottish Government, and is ranked in the most recent Chambers and Legal 500 directories for planning and property law. Alasdair has considerable experience appearing in actions, statutory appeals and judicial reviews at all levels, including the Sheriff Court, the Inner and Outer House of the Court of Session, the Lands Tribunal, and the Supreme Court. He also regularly appears in the Commercial Court of the Court of Session, principally in relation to property and contractual disputes. His broad range of experience includes dealings with commercial developments, wind farms, ports and harbours, challenges to local Development Plans, claims for compensation on compulsory purchase, and devolution issues. In addition to more traditional litigation, Alasdair has also appeared in hearings and public local inquiries before Reporters appointed by the Scottish Ministers. Alasdair regularly speaks at conferences and training events on commercial, property and planning law.
