Description

‘Some other substantial reason’ (‘SOSR’) is the fifth potentially fair reason for dismissing an employee under the provisions of section 98 of the Employment Rights Act 1996, but does it really cover a breakdown in relationships?

In this Early Birds session we will be looking at what is covered by ‘some other substantial reason’. Is it really just a useful ‘catch all’ category for achieving a fair dismissal that doesn’t fit neatly into one of the other categories? Or are there limits to the situations when SOSR will apply, meaning that it needs to be used with caution?

The session will look at the types of circumstances that might be included under the SOSR umbrella, with a particular focus on personality clashes and a breakdown in relationships between colleagues.

We will also provide a round-up of some of the key recent developments in employment law.
