PEAT Outcome - relevant legal knowledge

OBECTIVES

The law surrounding the care of elderly people is fraught with difficulties. The four main areas of concern are (1)Wills, (2) tax planning opportunities, (3) incapacity – Power of Attorney, Guardianship and Intervention Orders, (4) issues surrounding the protection of assets.

PARTICIPANTS

This seminar is aimed at those working with elderly clients including solicitors working in the areas of Private Client and Mental Health as well as those with an interest in the protection of elderly clients.

SPEAKERS

Fiona McDonald is a Private Client Partner with Fyfe McDonald. She is the co-author of the highly regarded legal text books ‘Inheritance Tax in Scotland’ published by Bloomsbury Professional and ‘The Elder Client’ published by W. Green & Son Ltd, and is accredited by the Law Society of Scotland as a specialist in Private Client tax Law.

Lianne Lodge is a Private Client Associate with Gillespie Macandrew. Having previously set up and headed a Lateryears team focusing on providing advice to the elderly and their families, Lianne has a particular interest in this area. She is a member of the national association Solicitors for the Elderly and the co-author of “The Elder Client”.

Essential Estate Planning for Elderly Clients – covering lifetime and death tax planning opportunities including income tax, capital gains tax, and inheritance tax, effective wills, death bed planning and relevant capacity issues taking into account the recent changes introduced by the Succession (Scotland) Act 2016 and the IHT residence nil rate band.

Lianne Lodge
Incapacity in relation to the Elder Client – Powers of Attorney issues and solutions, Guardianship and Intervention Orders, recent developments, dealing with vulnerable clients and issues around deprivation of liberty, protective and responsive strategies for long term care.
