With the event of media scares such as the Mossack Fonseca leaks, it is no longer enough just to comply with regulations – you now have to prove that you are complying.
As boring as some perceive Tax Evasion and the related regulations, Tax Evasion is increasingly being seen a Financial Crime that is a predicate offence to Money Laundering.
As a result, the IRS and Host Country Tax Authorities will be seeking to both enforce these regulations and want to be seen enforcing these regulations. Reputational damage and fines are inevitable for those least prepared to evidence compliance and good faith attempts to comply.
With regulators looking to ‘take scalps’ evidence of compliance is every bit as important as compliance itself. It will be those institutions that throw resources at the FATCA and CRS regime but are unable to achieve 100% compliance or evidence good faith attempts to comply that will make the easiest targets for regulator enforcement and the concomitant reputational damage that will follow.
This course will explain why 100% compliance within the deadlines is all but impossible for most Financial Institutions (for example, CDD on all accounts – both inside and outside of an IGA – is to be completed by June 2016) and will prepare you for what you can do about it now to protect yourself.
