Fiduciary duty: Securing the legal change we need

Fiduciary duty is an area of ongoing legal uncertainty and potential misunderstanding, with significant implications for the investment decisions made by pension trustees. Despite last year’s helpful report by the Financial Markets Law Committee, the legal position in relation to responsible investment remains unclear to many.

Increasingly, pension scheme trustees are encouraged to take account of systemic risks such as climate change, inequality and the biodiversity crisis. Trustees are also being invited to consider social factors and investing more in opportunities in the UK economy. As the UK government embarks on a significant programme of pension reform, there will be legislative opportunities to address these uncertainties and to provide pension trustees with greater legal confidence in acting to address social and environmental factors and to deploy capital in the domestic economy in the service of members’ interests over the long term.

This by invitation only event will bring together pension trustees from a variety of scheme types and other key stakeholders to discuss the opportunity generated by the government’s pensions review for clarification of the legal duties of investment fiduciaries. The event will include presentations on several current initiatives underway in this space.
