What to expect

Schleswig-Holstein's bold move not to continue to be part of Germany's failed gaming regulation has the potential to impact on the German regulatory landscape on a wider scale and could act as a wake-up call also for other German states.. A proposed Schleswig-Holstein state government coalition agreement, announced in June, would suspend the entry into force of amendments to the German Interstate Treaty on Gambling, effectively dooming it by ruling out the required unanimous ratification of all 16 states. Dubbed “S-Hexit”, the state government instead plans to ‘take back control’ and issue new legislation that will regulate the entire sector including sports betting, online casino and poker and comply with EU law.

Bearing in mind the regulatory situation Germany has been in for years now, it is clearly high time to reopen discussions and completely rethink Germany's approach towards gaming regulation.If the state again puts in place a licensing framework, this could represent a game-changer for the German online gambling market with opportunities for existing licence holders and also new operators targeting this potentially lucrative jurisdiction.
