Description

At present, there is no governance good practice guidelines specifically for third sector organisations in Scotland. Other jurisdictions have produced similar guidelines such as England and Ireland but to date the guidance is disjointed and not specific to Scotland.
The environment in which social enterprises operate is changing. Recent updates in legislation mean that boards have more regulation and are more accountable than ever before. The Scottish Government has indicated that there will an increase in reliance on the SE and wider third sector to deliver the services demanded by our communities. The first steps for the sector to be able to meet these demands is a more robust system of self-governance. Every social enterprise must have a clear vision of where it is going and good governance is a crucial part of an organisation and its ability to survive and meet its objectives. Boards of social enterprises tend to be non-executive and therefore a set of guiding principles would allow them to meet new and ongoing challenges and to lead in an effective manner.

Senscot Legal has been engaged by the Scottish Government to prepare a set of principles that social enterprises and the wider third sector can use to strengthen their boards and capacity of their organisations.
