In October 2024, significant new legislation came into force that places a strict, proactive duty on all employers: You must now take reasonable steps to prevent harassment of a sexual nature in the workplace. If an employer fails to do so, and harassment occurs resulting in a successful claim at an Employment Tribunal, the compensatory award — already uncapped — can be increased by up to 25%, meaning the financial risk is substantial!
Critically, this is not just about responding to complaints. The law imposes an anticipatory duty: employers must actively assess risks, foresee potential issues, and put measures in place to prevent harassment. You cannot afford to be reactive. Prevention is now a legal obligation.
