HR Junction is back! We hope you have had a super break and that you’ve not missed the Junction too much, whilst enjoying all that the Great British Summer might have thrown at you in the last couple of months. Anyway, the wait is over, the HR Junction returns on Thursday 10th October 2019.

In this first session back, we intend to talk about a fundamental feature of day-to-day employment law/HR practice … workplace investigations. Investigations can form the foundation of a range of workplace procedures, typically disciplinary cases, grievance processes and capability management. However, common as they are, how investigations are undertaken is often taken for granted, and flaws in this first stage of such procedures can cause major problems down the line, whether as a source of limitation of an employer’s future options or indeed a potential risk for a constructive or unfair dismissal.

Given our recent involvement in cases where employers have encountered such difficulties, we thought that a “back to basics” view of this critical area of people management would be a great place to start with our first Junction back after the summer break. At the session on 10th October, we intend to undertake a comprehensive review of workplace investigations, covering such specific issues as:

  • The core principles of an impregnable investigation
  • Who should conduct an investigation?
  • Who should be interviewed and how?
  • How to deal with issues of witness anonymity and confidentiality
  • How to manage an investigation in the context of an employee suspension
  • What to do if there are related criminal proceedings or charges

Such issues will be applied to a range of “real-life” examples, both from our experience and also no doubt from yours. If you have any additional specific aspects of workplace investigations that you would like us to cover please feel free to let us know in advance or bring them with you to the session.
