About the speaker and the talk:
Judge Alex Kozinski was appointed to the US Court of Appeals for the 9th Circuit in 1985 and was its Chief Judge from 2007 until 2014. He heard many IP cases (other than patents), the 9th Circuit including within it Hollywood and other creative centres.
Judge Kozinski will talk about the challenge that IP cases present to judges. He will speak of its growing importance and will explain why advocacy is so important in this field and how it can make a big difference. The talk will explore several intellectual property cases to illustrate some lessons in effective advocacy. In particular, these cases illustrate the power of concrete examples--in particular, concrete images and sounds--which often persuade in a way that abstract legal arguments do not. The power of concrete examples is not limited to the courtroom. They can also be used to persuade the court of public opinion, where the stakes as regards IP are often higher.
At the end of this talk students will have gained a profound insight into the importance of advocacy in IP cases and how to use concrete examples when they themselves are acting as advocates. They will also gain an insight into how an acute judicial mind assesses legal submissions.
This talk is accredited with 1 CPD hour by the BSB and SRA. It constitutes relevant CPD for IPReg.
