Antitrustitalia’s 53rd lunch talk is scheduled on Friday, 15 November 2019, 12:30 pm at the European Commission’s Directorate General for Competition (DG COMP)’s Auditorium in Brussels (Place Madou 1 │ 1210 Saint-Josse-ten-Nood │ Metro Madou).

Massimiliano Kadar, Deputy Head of Unit C.1 (antitrust in telecoms) in DG COMP of the European Commission and Thomas Franchoo, member of the Competition team of the European Commission’s Legal Service, will give a presentation in English on:

“The Commission’s power to order interim measures in light of the recent Broadcom decision”.

The Commission has not ordered interim measures since 2001 when measures against IMS Health were suspended by the President of the General Court. Since then, Article 8 of Council Regulation (EC) No 1/2003 has explicitly empowered the Commission to order interim measures in cases of urgency due to the risk of serious and irreparable damage to competition and on the basis of a prima facie infringement. That provision remained untested until the adoption of interim measures against Broadcom on 16 October 2019. Massimiliano and Thomas will discuss the Commission’s power to order interim measures in the light of the recent Broadcom decision.

Massimiliano Kadar is the Deputy Head of Unit C.1 (antitrust in telecoms) at the Directorate General for Competition of the European Commission and a visiting lecturer at King’s College London. Between 2011 and 2018, he has worked as case handler on both antitrust and merger control cases in a variety of sectors at the European Commission, and before then in private practice at Freshfields Bruckhaus Deringer LLP and Gianni Origoni Grippo Cappelli & Partners. Massimiliano has published several articles on competition policy and is a graduate of Bocconi University and King’s College London.

Thomas Franchoo is a member of the Competition team of the European Commission’s Legal Service since 2017. Before joining the Commission, Thomas was a counsel in the competition law practice group of Linklaters LLP in Brussels. Thomas holds a law degree from the University of Leuven (KUL), as well as LL.M degrees from the University of Durham (UK) and the College of Europe.

Lunch will be provided at 12:30, the presentation will begin at 13:00 and will close at 14:30. Important note: Please allow time to register at the Madou Tower desk, we recommend coming at noon.
