Intervening for the environment
Overview
An intervention is an opportunity for a non-party to participate in legal proceedings in which they have an interest. Being used increasingly by some of our most influential NGOs. and indeed regulators, this timely event will look at some recent examples of where the intervention mechanism has been used to great effect in environmental litigation.
Chaired by Richard Wald KC of 39 Essex Chambers and ELF’s Chair, we will hear from four brilliant legal practitioners on their recent experiences of interventions and reflections. Joining our conversation will be:
- Carol Day, solicitor at Leigh Day, RSPB consultant and ELF Vice Chair;
- Katie De Kauwe solicitor at Friends of the Earth;
- David Hart KC of 1 Crown Office Row, past ELF chair and now ELF Trustee; and
- Kate Tandy, Head of Litigation and Casework at the Office of Environmental Protection.
Amongst cases to be discussed where there was an intervention are Finch v Surrey County Council (Supreme Court) and Pickering Fishery Association v SSEFRA & Environment Agency (Court of Appeal).
