PEAT Outcome - relevant legal knowledge

OBJECTIVES

This seminar will include the following areas:

  • To demystify for the General Practitioner the uses of difficult types of Trusts
  • To illustrate the different types of Trust vehicles which can be used including the specific purposes for which particular types of Trust might be more useful
  • To consider the Tax profiles of the different types of Trust which might be used
  • To point out possible "risk areas" to Practitioners in setting up a Trust
  • To consider possible legislative changes in the fields of Scottish Trust Law

PARTICIPANTS

This seminar is aimed at general practitioners who might find themselves increasingly requested not only to assist clients with the preparation of Will's but also to advise in relation to Tax Mitigation. In particular, the seminar is aimed at Practitioners who do not specialise in Executry work but who may be regularly invited by clients to make Wills or to suggest methods for the financial protection of young or incapacitated Beneficiaries. The seminar is also suitable for paralegals involved in private client work including drafting Wills for clients as well as first and second year trainees.

SPEAKER

The speaker is John Kerrigan, Blackadders. John is a Consultant within the Blackadders Private Client Team and has over 40 years of legal practical experience, 34 of them as a Partner. He was a Tutor at the Glasgow Graduate School of Law for 12 enjoyable years tutoring diploma students in the subjects of Wills, Trusts & Succession. He has also been a member of the Trust and Succession Sub-Committee of the Law Society of Scotland since 2005. John has contributed to various articles to, inter alia, the Scots Law Times, The Journal of the Law Society of Scotland, The Scotsman and various other newspapers and periodical magazines. He is also current Editor of the Scottish Trusts and Succession Service provided by Greens. John is the author of “Drafting for Succession” now in its second edition. He is currently working on other legal literary works.
