Join us and our panel of experts for an IR35 awareness event specifically for Sheffield’s tech sector. Contractors, freelancers and tech businesses are all welcome.

This informal Question Time style panel discussion and interactive Q&A will be accompanied with refreshments (beer, pizza, soft drinks and snacks) and followed by a networking opportunity.

Why should I attend

The extension of off payroll IR35 legislation to the private sector from April 2020 will have a number of consequences for businesses, staffing companies, payment intermediaries and contractors/freelancers.

The new rules may be limited to medium and large sized end user businesses, however, they raise a number of practical considerations for contractors, freelancers and businesses alike:

  • Should staffing and intermediary companies adopt new supply models?
  • How can intermediary due diligence checks and IR35 assessment arrangements be strengthened?
  • What can be done to challenge “safety first” blanket IR35 determinations?
  • The real impact of the changes on contractors and freelancers working through personal service companies (PSCs)
  • What steps should be taken by contractors and freelancers in advance of April 2020?

The Panel

Scott Davies is Co-Founder and Director of tecy.digital, a service wrapped recruitment technology collaboration (powered by TribePad) on a mission to positively disrupt traditional recruitment in the digital/technology space. Scott witnessed first-hand the impact of IR35 legislation in the public sector in 2017.

Chris Humphreys is a partner and Head of Tax at BHP LLP. Chris is an experienced Tax Practitioner who prides himself on looking at tax issues with a commercial eye and is able to explain them in a way that takes the jargon out of complex tax legislation.

Catherine Wilson is a Partner and Head of the Specialist Employment Law team at South Yorkshire law firm, Keebles LLP. More information: What is IR35

The intermediaries legislation, or IR35 as it is better known, is HMRC tax avoidance legislation targeting ‘deemed employees’. These are workers supplying their services to clients via an intermediary, such as a limited company, who would be classed as employees under employment law if not for the intermediary, and so should be taxed as employees.

HMRC enforces the rules to determine whether a limited company contractor is a deemed employee for tax purposes. The legislation is notoriously complex. Falling foul of the Act can lead to substantial costs in back taxes, fines and penalties and liability can now be traced to not only the contractor’s limited company, but also the agency or end user business.

On top of this, falling inside IR35 means a contractor could suffer a 20% decrease in net take-home pay. Similarly, businesses adopting a blanket ‘no limited company contractor’ policy will find themselves either losing a large proportion of their workforce or a significant increase in costs to retain contractor services on a PAYE basis.

It’s no surprise that contractors are reluctant to take on contracts that are caught by IR35 and businesses do not want to take the risk of incorrectly assessing their flexible workforce.
