What is IR35?

The IR35 rules, initially brought in by the government in 2000, are designed to ensure that individuals who work like an employee, but who invoice for their services via an intermediary (such as their own limited company), pay broadly the same amount of income tax and National Insurance contributions (NIC) as other employees.

What is changing?

When it was first introduced, the responsibility for determining whether IR35 applied laid with the individual not the engaging party. The first major reform to the rules came in April 2017 when that responsibility shifted to the engaging party for those working in the public sector.

From April 2020, certain businesses working in the private sector will, for the first time, become responsible for reviewing the IR35 position in respect of individuals operating through an intermediary. The engaging party will be required to determine the individual’s employment status and, where this is deemed to fall within IR35, the fee payer will be required to withhold tax and NIC from payments made to the intermediary. Back taxes, interest and penalties will fall due on the engaging party should they fail to apply the IR35 rules.

Businesses that engage with individuals operating through an intermediary.

Recruitment agencies and other intermediaries who supply staff through an intermediary.

Individuals who supply their services through an intermediary and who would be deemed to be employed if engaged directly.
