Description

Barrister Penny Maudsley will be speaking for the morning session. Penny Maudsley came to the Bar having had a career as a nurse and a midwife within the NHS. This study day is open to all internal and external members of staff as well as students who would like to find about more about Legal Aspects.

The main focus of this study day will be the impact on the patient and the Trust and the practitioner. There will be a discussion around the current national fitness to practice hearings and the current Trust hearings, outcomes of these will be explored.

Morning session - Fitness to practice and implications of errors in practice including:

  • Documentation
  • Policies and guidelines
  • Women’s choice to follow policies and guidelines - impact on declining to follow
  • Medication errors
  • CTG: Inability to interpret, record keeping

Afternoon session - Negligence with regard to:

  • Duty: a moral or legal obligation; a responsibility
  • Breach of duty: if their conduct fell short of the standard expected under the circumstances
  • Foreseeability: reasonable anticipation of the possible results of an action
  • Causation: an action from which the specific injury or other effect arose and is combined with a state of mind to compromise the elements of guilt

Injury and harm will be presented by the Trust’s legal department.
