OBJECTIVES

Real rights have for many years been conceived as a protection against unfair disinheritance. In 2007, the Scottish Law Commission proposed that legal rights should be abolished for non-dependent adult children. That proposal has not been pursued and it is likely that legal rights will be with us for many years. Although in theory a straightforward concept, legal rights can be complex and can cause difficulty in relation to the speedy administration of a testate Estate. This Seminar will cover the following topics:-

  • Legal Rights can be claimed only out of moveable Estate – True/False
  • How are Legal Rights calculated?
  • Legal Rights and forfeiture
  • Legal Rights and minor children
  • Legal Rights and IHT
  • Collation – when does this apply and how do you calculate the same?

This seminar will be of interest to private client practitioners, particularly those having an interest in Law of the Elderly.

SPEAKER

The speaker is John Kerrigan, Partner, Morisons (formerly Maxwell MacLaurin). Mr. Kerrigan has been a Partner at Morisons for 36 years. He was a Tutor at the Glasgow Graduate School of Law for 12 enjoyable years tutoring diploma students in the subjects of Wills, Trusts & Succession. He has also been a member of the Trust and Succession Sub-Committee of the Law Society of Scotland since 2005. John has contributed to various articles to, inter alia, the Scots Law Times, The Journal of the Law Society of Scotland, The Scotsman and various other newspapers and periodical magazines. He is also current Editor of the Scottish Trusts and Succession Service provided by Greens. John is the author of “Drafting for Succession” now in its second edition. He is currently working on other legal literary works.
