WHY ATTEND?

Understanding relevant legislation is important for any business working in the construction industry, whether that legislation applies directly to them, or indirectly via their supply chain / main contractor. However, keeping up to date with the changes can be time-consuming and difficult. This seminar will provide a summary of the main recent changes in construction legislation and other legal developments.

WHO SHOULD ATTEND?

Anyone in the construction industry who is interested in the legislation and other legal aspects of construction, especially project managers, contract managers, in-house counsel, HR managers, site foremen, site managers, and small business owners.

CONTENT:

• The Effect of COVID-19 on Construction Contracts – how the most common forms of construction contract deal (or in some cases fail to deal) with the effects of COVID-19 and also looking forward to what might be required in future project contracts.

• Recent Developments in Dispute Resolution – the legislative context of the main dispute resolution processes available to the industry, a review of the recent developments and a consideration of what reforms may be on the horizon.

• Cash Flow and Debt Recovery in the Construction Industry – the protections that parties can seek to have written into their construction contracts and the practical steps that can be taken to identify problems early and to recover unpaid debts when they fall due.

• BIM Update – ISO Standards, how the common forms of construction contracts deal with BIM and recent case law on access to BIM models.

• VAT Reverse Charge – Outline of how the reverse charge, coming into effect from 1 March 2021 is intended to work and what contractual provisions may be required.

SPEAKER PROFILES:

Stuart Murphy – Stuart is a Partner in Carson McDowell LLP and head of the firm’s Construction Law Team. He has over 25 years’ experience of advising construction clients in relation to both contentious and non-contentious matters in Northern Ireland, Great Britain and internationally. He has extensive experience of the major industry standard forms of contract such as NEC, JCT, RIBA, ICC, FIDIC, ACE and many others. He also regularly acts for clients in construction disputes, including mediations, adjudications, arbitrations and litigation.

John Dugdale – John is also a Partner in Carson McDowell’s Construction Team. He advises on the entire project delivery process from end to end. He is familiar with the drafting and negotiation of all of the standard forms of contact used in NI and elsewhere. He has extensive experience of working with contractors, subcontractors, consultants, clients, funders and insurers in a wide variety of market sectors. His dispute resolution expertise includes mediation and negotiation, adjudication, arbitration and litigation.

Gavin Kerr – Gavin is an Associate in Carson McDowell’s Construction Team and is involved in all aspects of non-contentious contract drafting and negotiating as well as contentious construction disputes. He has significant experience on projects across NI and GB in all major sectors including commercial real estate, large scale construction and engineering, education, major infrastructure and energy (including renewables and alternative energy).
