Course Description

This three hour CPD programme has been designed to help all mediators understand how to identify the needs of parties who are disabled, how to help them prepare for the mediation, and how to conduct a mediation in a way that meets the needs of those parties.

The course is led by experienced mediator Keith Richards, a barrister who specialises in disability equality rights and also in designing and delivering disability awareness training across many sectors.

Apart from the mediators themselves, for most people involved in mediation dealing with disability is something they’ve not experienced before. For everyone who is agreeing to take part in a new or unfamiliar process they will need to know what’s going to happen and that they can have confidence in the process. And for most disabled people they will need reassurance that the process will be accessible for them. Marry those things together and there’s a recipe for even greater suspicion, uncertainty, anxiety, and lack of confidence than usual.

The label ‘disabled’ is unhelpful as it fails to tell us anything. But by labelling we make assumptions, or we paint a picture that puts someone in a pigeon-hole with no real understanding of whether that really applies.

Questions commonly asked are: What will happen on the day? Will my needs be met? Can I be confident that the process will be accessible? Will I be at a disadvantage? Will the mediator understand?

Keith will cover:

  • Pre-mediation arrangements

  • Attitude, etiquette, language and dynamics

  • Ditching the labels and setting the tone for a successful mediation session

  • Setting up and running a successful accessible mediation process

  • Ensuring the parties are confident and comfortable before and during the process

  • Understanding the needs and expectations of disabled people and meeting their expectations in a confidential and empathetic environment

  • Common situations, and being prepared for the unplanned.

This programme is worth 3 CMC CPD points.

Your Trainer

Keith Richards is a barrister, arbitrator, accredited mediator and consultant Lawyer at Lawbite.co.uk. He has been a lead member of the Disabled Persons Transport Advisory Committee (DPTAC) for many years and has served as its Chair for the last 4 years. DPTAC is an Expert Committee at the Department for Transport.

Keith’s experience of designing and delivering disability equality and awareness training in a wide variety of sectors spans over 20 years.

He works daily with disabled people and with sectors that deliver services to them. He helps to ensure that businesses and professionals make their services accessible not because the law requires it but because it’s part of good quality professional and customer service.
