Event Details

This workshop with expert facilitators will provide a brief legal overview and considerable practical guidance on the complex issues around the documents, processes and hearings required for preparing for and carrying out conduct and capability disciplinary actions.  Gwynneth Tan and Navi Atwal will facilitate this interactive workshop giving practical explanations of how organisations can improve their processes, documents and hearings to ensure staff are treated legally, ethically, fairly and compassionately while the organisation carries out necessary performance management for business reasons.  They will explain how all the necessary documents can be written effectively.  They will give guidance on legal and good practices, explaining how the evidence should be identified, explored, managed and discussed during the required processes following legislation and case law.  They will remind those attending of the relevant legislation and learning derived from case law, while explaining how difficult discussions can be made productive even during disciplinary hearings.  They will demonstrate how to add to existing practices, policies and procedures to be legal and effective employers and businesses.  


This event forms part of a series under the running title “Wave Goodbye and Say Hello” offering members a range of topical subjects for both generalists and specialists.  You will be supporting your Continuing Professional Development because through working with the facilitators, you will understand how to be:


•Purposeful:  designing and managing effective processes which benefit employees and the organisation

•Agile:  working with the latest theories on effective information gathering and presentation

•Collaborative:  learning from good practices in organisations including practical analysis of effective conduct and capability disciplinary procedures

•Expert:  explaining the legal issues and case law on disciplinary processes
