GDPR is almost upon us, and many businesses are still not sure what it is or if/how it will effect them. 

Don't bury your head in the sand, there is plenty of support available to help you plan, identify and mitigate risks and lower your chances of getting things wrong. 

Doing things in easy to digest steps will help it all make sense, and managable.


From May 25th 2018, the way organisations are allowed to hold, collect and process peoples personal data will be changing. No matter how large or small a business is, they will need to comply with the new laws. 

Although there is a lot of scaremongering focussing around increased fines of up to £17M or 4% of global turnover, businesses should be seeing GDPR as an opportunity to instill customer confidence and demonstrate that they use the data they hold in the correct ways. It can actually help you keep existing customers and even win new clients if you can demonstrate that you are taking GDPR seriously. 

The reality is that micro and SME businesses are unlikely to face the huge fines like the ones noted above,  correctional measures are always preferred by the ICO, but note that "smaller" fines of even £000's for getting things wrong could have significant implications on a businesses cashflow. Under DPA and PECR, organisations are already feeling the impact, GDPR will be bringing awareness of data privacy to the masses, letting data subjects like you and I know that we have increased rights about the data that belongs to US! 


Recent actions by the ICO: 

  1. An energy company were recently fined £1,000 for sending just 1 customer the wrong account information. 
  2. A home improvements company was given a £50,000 fine and was issued with a formal Enforcement Notice, requiring it to cease contacting people registered with the Telephone Preference Service
  3. A marketing company faced a £350,000 fine after they failed to ensure that calls were only made to individuals who had consented to receive marketing.


Under GDPR EU citizens will have increased rights and organisations have increased obligations to ensure that information is not misused. The recent cambridge analytica and Facebook scandal has highlighted how data can and has been misused in the past and this needs to change. 

As consumers we will all welcome these changes, but as businesses there are challenges to overcome.
