Description

This half-day workshop will provide delegates with a comprehensive overview of the rights, entitlements and immigration options for migrant children in local authority care. Aimed at professionals (legal and non-legal) working with this group of children, it will set out the applicable legal framework in terms of care arrangements in Scotland and the duties and responsibilities associated with these. It will also focus on the importance of UK immigration law to care planning, and will provide a clear breakdown of UK immigration law and the various immigration avenues that are open to migrant children in care. Furthermore, it will look at other related issues such as access to education.

Objectives

By the end of this workshop, delegates will be able to:

  • Recognise the particular vulnerabilities these children may present with
  • Explain the legal framework which governs how migrant children are looked after in Scots Law and what they are entitled to
  • Understand how UK immigration laws apply to these children and their importance to care planning
  • Identify what best practice looks like when working to ensure that these children have long-term protection and can access their rights and entitlements

Target Audience

This workshop will be of interest to professionals who work with migrant children, including lawyers and those in a non-legal capacity. It may particularly be of interest to individuals who work in statutory services, for example social workers, or third sector organisations who work with children in care in Scotland, such as advocacy services.

Facilitator

Andy Sirel is an Associate and heads our project JustRight for Refugee Children. He has an LLM in International Human Rights Law and has been working in human rights law for over 7 years. Andy spent two and a half years working in a national law centre, leading a project providing legal representation to migrant children and young people. He is experienced in working directly with unaccompanied asylum seeking children and child victims of trafficking, as well as previously accompanied migrant children in care. He is particularly interested in age assessment, access to education and ensuring that migrant children can access their rights and entitlements in local authority care. He currently sits on Scottish Government working groups on child trafficking and age assessment.
