Theme: An unfair dismissal case involving misuse of social media. Delegates will be provided with an advance copy of the ET bundle documents and witness statements to enable them to follow the ET proceedings as the case unfolds. This is an event that was successfully delivered by Freeths in partnership with ACAS in November 2017. Since the removal of ET fees, we are starting to see the number of ET claims increasing so this is an ideal opportunity to learn how to avoid and deal with ET claims.

Mock Employment Tribunal for CIPD members – in association with Freeths LLP


This session will be an opportunity for HR professionals to experience what goes on at an Employment Tribunal. Delegates will watch an unfair dismissal scenario unfold, hear the evidence and to see how decisions are made.

The case relates to the topical issue of misuse of corporate social media, which because of its very public nature has potential to cause reputational damage. Needless to say, the case is entirely fictional.

Scenario: As a result of an incident involving comments on a company Twitter account, which were deemed to be harmful to the business, the Claimant was dismissed for gross misconduct, which she believes to be unfair.

During the course of this hearing, the parties will be cross-examined – by legal representatives, but members of the audience with also have the opportunity to put questions to the witnesses. After hearing closing submissions, the audience will have the opportunity to give their view on the outcome of the claim. Finally, there will be an opportunity to question the participants on the process and reasoning behind the decision.

Mark Emery, an employment partner at Freeths, and also a Tribunal judge, will chair this mock Tribunal. Delegates will benefit from his insights of how a Tribunal works and the key points that are likely to affect the final decision. Other members of Freeths’ employment team will play roles in this Tribunal enactment.

In order to give you the opportunity to get involved, the case bundles will be circulated electronically in advance so that you have all the facts and can follow the witness statements.

If you haven’t attended a Tribunal before, this will give you an invaluable insight into the process and how decisions are reached.
