11:00 – 11:45 Suspicious Activity Reports and Suspicious Transaction and Order Reports, two sides of the same coin or completely different processes!?

On October 18, the Financial Conduct Authority published a letter giving guidance on the distinction between suspicious activity reports (SARs) and suspicious transaction and order reports (STORs). The letter was sent in response to a request by UK Finance, a trade association, following a meeting of the ‘SARs Collaboration Working Group.’

This presentation, will assess the similarities and differences between SAR and STOR regimes, their respective legislative backgrounds, and best practice guidance which Firms should seek to follow when navigating their reporting requirements.

11:45 – 12:30 With Friends Like These.... PEPs and their "Not so Close" Associates

The last 24 months has seen a number of bribery and corruption cases involving PEPs. A number of these cases appear to involve parties that do not fit neatly into the definition of a "close associate" found in the UK's and EU regulatory requirements.

This presentation will consider the latest tactics used to furnish PEPs with illicit payments and luxury goods that involve entities and individuals with no apparent connection to them.

13:30 – 14:15 Sanctions Risk in a Volatile World

Sanctions are now the go-to tool of US and EU foreign policy, often being imposed with little or no notice, creating compliance nightmares for companies and exposing them to criminal prosecution and huge fines. This session examines the latest themes across both US and EU sanctions landscapes, and in particular the problems caused by divergence between the two. It will explain US extra-territorial reach by way of secondary sanctions, the measures the EU has taken to protect EU companies and the resulting litigation. Sanctions post Brexit will also be explained with some predictions at where the UK’s foreign policy may tilt

In an ever-more complicated regulatory environment, firms are still struggling to truly understand their responsibilities and obligations regarding the identification and verification of their customers’ source of wealth and source of funds.

Whilst UK and international regulatory standards and requirements both make clear the importance of establishing source of wealth and source of funds, practical guidance is limited and the stakes are high. In this session, Fiona will discuss the differences between source of wealth and source of funds; when these need to be identified and verified; what documentation firms should be collecting; and some examples of good and bad practice.

Mike is a recognised authority on automated payments and, as Chief Executive, led Bacs Payment Schemes Limited (Bacs), the UK’s biggest retail payment system, from 2004 until 2018. During which time he successfully steered the company through a record number of payment processing, technological, regulatory and innovative customer proposition ‘firsts’.

Under Mike’s direction, Bacs extended its product offering to include the ownership, management and market adoption of the Current Account Switch Service (CASS) and the Cash ISA Transfer Service.
