In 2013, employers welcomed the introduction of the ability to hold frank discussions with employees about potentially parting company which could not be quoted back at them in a Tribunal.
However, there are rules and limits which must not be breached. It is still possible to end up in an expensive Tribunal hearing arguing about the very discussion which you thought was protected.
