Following the UK Supreme Court judgment in For Women Scotland v The Scottish Ministers made in April 2025, it was ruled that in the Equality Act 2010, a ‘woman’ is a biological woman or girl (a person born female) and a ‘man’ is a biological man or boy (a person born male). The ruling has caused widespread confusion and concern, and LGBT Foundation sought to involve as many people as possible in EHRC's consultation this summer to inform the statutory guidance.

After the consultation period the Equality and Human Rights Commission (EHRC) is preparing to publish its updated Code of Practice on services , public functions, and associations . Consequently many organisations are seeking clarity on how to remain inclusive while complying with evolving legal interpretations.
