Summary: A 90-minute virtual training session as part of our Legal Update Series for HR and OD practitioners, delivered by Geetika Bansal, Legal Director, and Clare Moore, Associate from DAC Beachcroft.

The NHS People Plan 2020 provides that "The NHS must welcome all, with a culture of belonging and trust. We must understand, encourage and celebrate diversity in all its forms".

It is recognised that there are complex issues of representation within the NHS workforce with a desire to improve representation within the bounds of the law.

In this session, we will explore the "positive action" provisions of the Equality Act both in general terms and within the context of recruitment and training. We will discuss the risks of the types of claims that could arise from taking such action and steps that employers can take in order to minimise the risk of successful claims being brought.


By the end of this webinar you will be able to/have:

· an understanding of the positive action provisions of the Equality Act in general and in the context of recruitment and training;

· an understanding of the circumstances where taking positive action may be justifiable; and

· understand and evaluate risk areas.

Facilitator: Geetika Bansal (Legal Director) and Clare Moore (Associate) from DAC Beachcroft LLP

Geetika Bansal is an experienced employment lawyer who works in the health sector and has significant experience of advising public and private sector organisations on all aspects of employment law.

Geetika has extensive experience of advising complex Employment Tribunal claims relating to discrimination, unfair dismissal and whistle-blowing. She also represents clients in Civil Court litigation in relation to breach of contract claims and injunctive relief. Geetika provides assistance to clients on day to day advisory queries, including conducting grievances and disciplinary processes and termination of employment, drafting and negotiating settlement agreements, consultancy agreements and employment contracts.


Clare Moore is an employment lawyer who has experience of advising clients across a range of sectors on all aspects of employment law.

Clare advises and represents clients in Employment Tribunals in relation to claims for unfair dismissal, discrimination, whistleblowing and breach of contract. Clare also provides advice to clients on day-to-day employment issues, including disciplinary processes, grievances and sickness absence.#
