Overview

The new General Data Protection Regulations (GDPR) will apply to all personal data employers hold on employees. Employers collect and store a whole range of information relating to their employees, from bank details to health records, personnel files and documents relating to disciplinary and grievance procedures. Employers also regularly transfer this information to third parties, for example payroll and benefits providers. In order to comply with the GDPR employers will need to fundamentally change their approach to data protection, from relying on general consent to identifying the specific legal basis upon which they can process each type of information and providing more detailed information to employees.

Our practical session on GDPR for employers will look at the changes employers need to make to their policies, employment contracts and employment documents, and guide you through the changes you need to implement to become GDPR compliant.

The GDPR training will cover the following key areas:

  • DPA v GDPR – What employers need to know
  • The general principles employers must follow when processing data
  • Additional requirements for “special categories” of data (sensitive personal data)
  • Why consent can no longer be relied on by employers
  • The grounds that employers will need to rely on now to process data
  • Identifying the information the employer holds and why
  • Identifying how long you should store data for
  • Dealing with the inadvertent or unauthorised storing of data by employees, for example in email systems
  • Requirements for transferring data to external providers, for example payroll and professional advisers
  • Translating GDPR obligations for employees – how can we make your policies user friendly?
  • Changes employers need to make to employment documents and policies
  • Dealing with subject access requests from employees
  • Training employees and managers on handling personal data
  • Practical issues – We will finish the session by looking at worked examples of how GDPR issues may affect the following key areas:
  • Recruitment
  • Managing ill-health
  • Disciplinary and grievance proceedings
  • Contract and policy wording
