Summary:

DAC Beachcroft invite you to a 90-minute virtual training session on Protected Views and Social Media. In this session, we will navigate tricky ER issues involving employees who express beliefs and make comments in social media and we consider how to manage situations in which there are competing views which might be protected under the Equality Act 2010 and through the right of freedom of expression.

Through this session, we will look at the key issues that might need to be addressed by HR when dealing with protected views, including:

· Identifying beliefs that might be protected;

· Balancing the rights of those with competing views and beliefs;

· Identifying what actions might amount to misconduct;

· Identifying what might amount to unlawful discrimination.


Objectives:

The objective of this virtual training session is to provide attendees with the tools to:

· Understand the law on protected beliefs and freedom of expression;

· Manage employees' rights to express their views and beliefs;

· Be able to recognise where disciplinary action may be warranted;

· Manage the risk of unlawful discrimination.


Outcome:

To extend your understanding of this complex area of the law through caselaw examples.

Facilitators:

Nick Chronias

Nick Chronias, Partner, is recognised as a market leading employment lawyer in the health sector and has significant experience of advising public and private sector organisations on all aspects of employment law.

Nick has given advice at national level on many employment issues within the NHS. He has also dealt with highly complex cases on the management of doctors as well as successfully defended many complex discrimination claims.

Nick is a specialist in trade union relations and multi-party employment cases. He represented the employers in the largest single test case in Employment Tribunal history. Nick is also an experienced litigator. He handles cases in Employment Tribunals, the High Court and right up to the Supreme Court


Sally Christopher

Sally Christopher, Senior Associate, has a particular focus on contentious and non-contentious work for the NHS. Sally regularly advises on complex internal procedures, such as disciplinary, grievance and whistleblowing investigations, as well as TUPE, restructures, redundancies and changes to terms and conditions.

Sally has significant litigation experience, advising on complex Employment Tribunal and High Court claims, including whistleblowing, discrimination and breach of contract claims, and with particular expertise in multi-claimant litigation.
