Key changes under 5AMLD and the MLRs

The transposition of the 5th anti-money laundering directive came into UK law on the 10th of January.
We will review of key changes to the domestic regime and deep dive what these mean for firms, including:

  • Supervision of custodian wallet providers and exchanges; and

  • Senior management assessment under the fit and proper requirements. We shall begin by looking at the process for completing these obligations and how we can help fulfill them.


Analysis of the Virtual Currency and asset landscape

We will unpack the developing virtual currency landscape and the make-up of exchange tokens, security tokens and the newly created class of e-money tokens.

We will also look at a number of Case Studies where virtual assets have been used in money laundering and terrorist financing schemes.


Risk assessing these types of clients and transactions

We will address the difficult task of risk assessing crypto elements.

This will include discussions around underlying risk typologies and how to categorise certain tokens and exchanges.

Managing VC Risk

Penultimately, we will look at the way in which firms can manage exposure to risk when dealing with virtual currencies. This will include a look at the enhanced requirements under 5AMLD including a summary of industry best practices surrounding Source of Funds evidence and ongoing screening. Furthermore, we will discuss the application of effective compliance monitoring procedures under the new regime.
