This half day course will cover requests for information under all the legislation that is available to the public, that is:

  • the Data Protection Act 2018
  • the Freedom of Information Act 2000 and
  • the Environmental Information Regulations 2004.

It will also cover how to recognise and respond to vexatious requests.

There is a lot of jargon out there and a lot of misinformation. The High Court has defended parish councils hit by an onslaught of vexatious requests by acknowledging that parish councils are not departments of state and that governance is rarely improved by firing endless questions at volunteers.

Equally, the Information Commissioner expects public authorities to be transparent and open.

This course will cover:

  • Subject Access Requests under the Data Protection Act 2018
  • Key changes from the old system and important updates to your policies
  • Handling requests under the Freedom of Information Act
  • Applying exemptions including the personal data exemption
  • The Public Interest Test
  • Handling requests under the Environmental Information Regulations and when it is important to know which legislation you are using.
  • Vexatious requests – how the law defines them and what you can do including a recent case law update.

The tutor is a solicitor and former Head of Legal and Monitoring Officer who has advised and trained on the Freedom of Information Act 2000 from the outset and has had responsibility for compliance with information legislation at both district and unitary councils. She has run her own practice for nearly eight years and advised many authorities on how to deal with vexatious requests.

Registration will commence at 9:30am with the course starting promptly at 10:00am. Refreshments on arrival. Parking is available but does fill up quite quickly. Darke Hall is in the Coach House, adjacent to the Main Gate at Green Park, keep to the left as you drive in.

Cancellation Policy

A full refund will be given if 14 days or more notice, prior to the date of the training course, is given.

Full charges will be levied and no refund will be available when a booking is cancelled within the 14-day period prior to the date of the training course. In exceptional circumstances we may be able to defer the booking, please contact us in writing at balc@bucksalc.gov.uk. Cancellation or deferment is entirely at the discretion of B&MKALC.

Delegate fees are transferable to other councillors or employees of your council to attend the training event booked.
