Right to work checks: are you carrying them out correctly?
Presented by Shoosmiths LLP
Right to work checks can often be seen as an essential but unimportant part of the recruitment process, and can sometimes be carried out without due care and attention to the importance of the check. In 2016 the government hardened its approach to immigration offences and gave employers an increased responsibility to ensure that they don’t employ anyone who doesn’t have the right to work in the UK. The penalties for employing an illegal worker have increased over the last few years, and failure to carry out a check correctly can now lead to a fine of up to £20,000 per illegal worker, and could even result in a custodial sentence. Are you confident that you and your team are carrying them out properly, in accordance with the latest guidance from the Home Office?
In this essential session Hayley Gilbert, Associate from Shoosmiths LLP, will take you through how to carry out a right to work check correctly, how to identify counterfeit and fraudulent documents, how to fairly dismiss an employee who cannot provide evidence of their right to work, and what to do if you think that your right to work checks have not been carried out correctly in the past.
