Technical Expertise Vs Subject Matter Experience and Competence for Construction Arbitrators. By Emmanuel Dike LLM, FICIArb, FCAb, FCIArb
Abstract
In selecting a construction arbitrator for a dispute arising from a construction contract, parties often require an arbitrator with some measure of exposure in the area of construction to resolve their dispute. The degree of exposure in construction required of an arbitrator depends on the parties’ choice of words in their arbitration agreement.
This webinar will explore the requirement of the possession of technical expertise in a particular field of construction as opposed to a professional who though may not be a technical expert in that particular field; but non the less possesses sufficient subject- matter competence and experience in dealing with construction contracts and understanding the nuances of the dispute for a fair and efficient settlement in an arbitration.
The key takeaway to attendees is to broaden the choice of the selection of suitable construction arbitrators by users.
