Different Views? Children’s Lawyers and Children’s Participation in Protective Proceedings

Dr Nicola Ross, Senior Lecturer, University of Newcastle, New South Wales

 

Fierce debates about the appropriate role of children’s lawyers in child protection have erupted in Australia and overseas since the 1990s, with different models of legal representation for children incorporated into legislation. This seminar will examine how children’s lawyers in the New South Wales child protection system think about their practice and formulate their approach to the representation of children. It is based on a qualitative study undertaken in 2006 that asked lawyers how they work with children and how they think about children’s participation.

 

Keeping children in care safe: the importance of participation

Faith in Australia’s child protection systems has been rocked by a series of inquiries which have highlighted how children in care have been abused, mistreated and placed in unsafe environments. As in Wales and England in the 1980s and 1990s, a common theme to emerge in the Australian context is that victims of abuse did raise concerns with adults, but were not listened to or believed. Reflecting on recent research into participation of children in the care system in Europe and Australia, this paper re-examines the role of children’s participation in keeping children in care safe.

 

 

Nicola Ross is a Senior Lecturer at Newcastle Law School, where she teaches Family Law, Child Law and International Child and Family Law. She is qualified in both law and social work and has practiced in both professions. Her research interests include children’s participation rights, lawyers’ work with children, family law, child protection, adoption and inter-professional collaboration. Anne Crowley recently completed a research fellowship at University of Newcastle, NSW, where she developed a research proposal on participation of children in out-of-home care. Anne has undertaken research with children and young people on issues including youth crime, public care, advocacy services and child poverty.
