On the 25th May, the new General Data Protection Regulations come into force.

The General Data Protection Regulation (GDPR) is new European legislation, replacing the existing European Directive 95/46/EC.

Despite Brexit, GDPR will apply in the UK from 25 May 2018 onwards.

These new rules potentially have implications for any organisation or small business (or sole trader) that keeps any information on customers, prospects, staff etc.

You may need to demonstrate that you have specific policies for dealing with your records, whether electronic or on paper. These could include demonstrating that you have assessed why that data is held and why it is justified. You may have to delete sections of your marketing or staff databases on a regular basis, provide additional written information to staff and customers and update employment and other contracts. You may have to keep a record of how and when consent was gained. There are new rights of erasure, access and new regulations relating to under 16s. There are much tighter restrictions on information sharing, direct marketing and automated processing (including staff recruitment) and duties that relate to reporting of breaches or loss of information.



A lack of preparation for the GDPR could be the result of smaller businesses that have been outside previous EU directives on data protection. “There are a lot of smaller companies and tech start-ups that are not caught by existing EU law, but will be caught by the GDPR. Within that population, the vast majority are just waking up to it, purely because they did not anticipate that the GDPR would apply to them... Many businesses appear to be sleepwalking towards a GDPR abyss," People Management. January 2018.

Failure to comply can lead to fines of up to £17 million or 4% of annual turnover if that is larger.
