Dr. Riz Mokal (South Square, UCL, and Aberdeen University Law School) and Prof. Sarah Paterson (LSE) go head to head to battle out how the restructuring plan benefits should be allocated across classes when the court uses its discretion to grant cross-class cram-down.

Prof. Sarah Paterson teaches and researches corporate reorganisation and insolvency at the LSE. Before joining the LSE, she was a partner with Slaughter and May in London with whom she retains a consultancy. Sarah is a former president of the ILA.

Dr. Riz Mokal is a barrister at South Square, Honorary Professor at UCL, and Associate Member of the Aberdeen University Law School. Before taking up full-time practice, he held the Chair of Law and Legal Theory at UCL, and from 2009 to 2013 was Senior Counsel to the World Bank and Head of the Bank’s Global Initiative on Insolvency.

Donald S. Bernstein chairs Davis Polk's Restructuring practice and is globally recognised as a leading restructuring lawyer. He was elected as Chair of the National Bankruptcy Conference in the US and President of the International Insolvency Institute. He is a Fellow and former Director of the American College of Bankruptcy, and was a member of the ABI Commission to Study the Reform of Chapter 11.
