Under the Health and Care Act 2022 all CQC-regulated providers must ensure their staff receive training in learning disability and autism that is appropriate to their role.
This is supported by the Oliver McGowan Code of Practice, which sets out how to meet this legal duty.

This applies to all services
Even if your service does not currently support autistic people or people with a learning disability, this requirement still applies.
People with learning disabilities and autistic people may use a wide range of services, including general, older people’s, and non-specialist settings. In some cases, individuals may not have a formal diagnosis or may not have disclosed it. Therefore, all staff must be equipped with the knowledge and skills to provide safe, respectful, and inclusive care.

The Oliver McGowan Mandatory Training is the government’s preferred training of meaningful training for health and social care staff on learning disabilities and autism.
The Tier 2 course is co-delivered by trainers with lived experience and covers:

  • Avoiding diagnostic overshadowing
  • Common co-occurring conditions
  • Legal frameworks (Mental Capacity Act, Human Rights Act, Autism Act, Equality Act)
  • Reasonable adjustments, including hospital passports
  • Appropriate DNACPR application
  • Professional culture, biases, and their impact
  • Accessible communication
  • Understanding and responding to individuals and families
  • Ask Listen Do framework
  • Learning from LeDeR
